Terms + Conditions of Sale
These Terms and Conditions of Sale ("Terms") govern all transactions between Tile Ezy Pty Ltd (“Cheap Tiles Online") and its customers ("the Customer"). By placing an order, the Customer agrees to be bound by these Terms. These Terms comply with Australian Consumer Law (ACL) and other relevant legislation.
1.1 These Terms apply to all quotations, orders, and sales of goods provided by Tile Ezy Pty Ltd unless otherwise agreed in writing.
1.2 Tile Ezy Pty Ltd reserves the right to amend these Terms at any time without prior notice. Updated Terms will apply to all subsequent orders.
1.3 These Terms are governed by the laws of Queensland, Australia, and any disputes will be resolved in the courts of Queensland.
2.1 Quotations:
- Quotations are valid for 7 calendar days unless otherwise specified.
- All prices in quotations are subject to change based on material costs, exchange rate fluctuations, or other factors outside Tile Ezy Pty Ltd’s control.
2.2 Orders:
- Orders must be submitted in writing. Tile Ezy Pty Ltd is not responsible for errors resulting from verbal orders.
- An order is confirmed only when Tile Ezy Pty Ltd issues a written confirmation.
- Amendments or cancellations to an order must be made in writing and are subject to clause 11.
2.3 Customer Responsibility:
It is the Customer’s responsibility to ensure the accuracy of all order details, including product specifications and quantities. Tile Ezy Pty Ltd is not liable for errors arising from incorrect Customer instructions.
3.1 Prices:
- All prices are in Australian dollars (AUD) and include GST unless stated otherwise.
- Prices are subject to change without notice. The price applicable to an order is the price at the time of dispatch.
3.2 Payment Terms:
- Full payment is required within 30 days of ordering or before dispatch or collection whichever is sooner unless otherwise agreed in writing.
- Tile Ezy Pty Ltd is not liable if a product runs out of stock if full payment was not received within the 30 days.
- Trade Customers with approved credit accounts must adhere to the payment terms specified in their credit agreement.
3.3 Deposit Requirements:
- 50% deposit is required to hold stock. Tile Ezy Pty Ltd is not liable if a product goes out of stock prior to receiving full payment.
- A non-refundable deposit of 100% of the item value is required for custom-made orders, special-order in items.
3.4 Late Payments:
- Overdue payments will attract interest at 2% per month, calculated daily from the due date until payment is made in full.
- Tile Ezy Pty Ltd reserves the right to suspend or cancel future orders or deliveries for overdue accounts.
4.1 Delivery Terms:
- Delivery times are estimates only. Tile Ezy Pty Ltd is not liable for delays caused by factors outside its control.
- The Customer must provide clear delivery instructions. Additional fees will apply for re-delivery if the Customer is unavailable, or the location is inaccessible.
4.2 Delivery Charges:
- Delivery fees are based on the destination, size, and weight of the order.
- Charges for re-delivery or failed delivery attempts will be borne by the Customer.
4.3 Risk:
- Risk in the goods passes to the Customer upon delivery to the nominated address or collection by the Customer or their representative.
- Tile Ezy Pty Ltd is not responsible for the safe storage or handling of goods after risk has passed.
4.4 Inspection on Delivery:
- The Customer must inspect goods upon delivery. Any damage, shortages, or discrepancies must be reported in writing within 48 hours.
5.1 Change of Mind:
- Tile Ezy Pty Ltd may not accept returns or offer refunds for change-of-mind purchases. Customers are advised to ensure product suitability before placing an order.
5.2 Eligibility for Returns:
- Returns will only be accepted for:
- Damaged goods reported within 48 hours of delivery.
- Faulty goods covered under the manufacturer’s warranty.
- Goods incorrectly supplied by Tile Ezy Pty Ltd.
5.3 Conditions for Returns:
- Goods must be returned in their original, unused condition and packaging.
- Goods must be returned within 14 days of agreed collection date or delivery date.
- Minimum amount for return is 4 boxes or 5.76M2, whichever is less.
- A restocking fee of 30% of the product value applies to all returns, excluding faulty or incorrectly supplied goods.
- Returns must be pre-approved by Tile Ezy Pty Ltd.
5.4 Non-Returnable Items:
- Custom-made products, special-order in items, discontinued lines, or clearance items are strictly non-returnable unless they are faulty or incorrectly supplied.
5.5 Refunds:
- Approved refunds will be processed within 14 business days of the goods being received and inspected. Refunds will be issued via the original payment method.
- Delivery charges are non-refundable, and the Customer is responsible for the cost of returning goods unless the return is due to a fault or error by Tile Ezy Pty Ltd.
6.1 The Customer is responsible for and must inspect all goods upon delivery or collection. Any visible defects or issues must be reported within 48 hours.
6.2 If no claim is made within this timeframe, the goods will be deemed accepted as delivered, and no further claims will be entertained.
6.3 Use or installation of goods constitutes acceptance, and Tile Ezy Pty Ltd is not liable for defects or issues discovered after installation.
7.1 Goods are supplied with the manufacturer’s warranties. Warranty details are available upon request.
7.2 Warranties do not cover:
- Normal wear and tear.
- Improper installation or maintenance.
- Damage caused by misuse, neglect, or environmental factors.
7.3 Warranty claims must be submitted in writing, including proof of purchase and supporting evidence.
8.1 Natural products may have variations in colour, texture, size, and finish. These variations are inherent and not considered defects.
8.2 The Customer is responsible for ensuring the suitability of products for their intended purpose. Tile Ezy Pty Ltd accepts no liability for unsuitable product selection.
9.1 Tile Ezy Pty Ltd’s liability is limited to the repair, replacement, or refund of goods in accordance with ACL provisions.
9.2 Tile Ezy Pty Ltd is not liable for indirect, incidental, or consequential damages, including installation costs or loss of profits.
9.3 The Customer indemnifies Tile Ezy Pty Ltd against any claims arising from the use, installation, or resale of the goods.
10.1 Tile Ezy Pty Ltd is not liable for failure to fulfil obligations due to events beyond its control, including but not limited to natural disasters, strikes, pandemics, or supply chain disruptions.
10.2 In such cases, Tile Ezy Pty Ltd will notify the Customer promptly and work to mitigate delays.
11.1 Cancellation Policy:
- Orders cancelled more than 24 hours after confirmation will incur a cancellation fee of 10% of the total order value.
11.2 Special-Order Items:
- For custom or special-order items, cancellations are not accepted and will incur a fee of 100% of the total order value, reflecting the non-refundable deposits and associated costs.
11.3 Non-Cancellable Items:
- Orders for goods already dispatched, produced, or customised are strictly non-cancellable, and the Customer will be liable for the full order value.
11.4 Refund of Pre-Payments:
- Any pre-payments made will first be applied to cover the cancellation fee. Any balance will be refunded within 14 business days via the original payment method.
These Terms are governed by the laws of Queensland, Australia. Any disputes will be resolved in the courts of Queensland.
